TERMS AND CONDITIONS FOR ACCOMMODATION CONTRACT

Article 1 (Scope of Application)

  • Contracts for Accommodation and related agreements to be entered into between this Guest House and the Guest to be accommodated shall be subject to these Terms and Conditions. Any particulars not provided for herein shall be governed by laws and regulations or generally accepted practices.
  • In the case when the Guest House enters into a special contract, insofar as such special contract does not violate laws and regulations or generally accepted practices, the special contract shall take precedence over the provisions of these Terms and Conditions, notwithstanding the preceding paragraph.

Article 2 (Application for Accommodation Contract)

  • A Guest who intends to make an application for an Accommodation Contract with the Guest House shall notify the Guest House of the following particulars:
    • (1) Name of the Guest(s);
    • (2) Date of accommodation and estimated time of arrival;
    • (3) Accommodation charges (based on the Appended Table);
    • (4) Other particulars deemed necessary by the Guest House
  • If Guests request to extend their stay, during their stay, beyond the date in subparagraph (2) of the preceding paragraph, it shall be regarded as an application for a new Accommodation Contract at the time such request is made.

Article 3 (Conclusion of Accommodation Contracts, etc.)

  • A Contract for Accommodation shall be deemed to have been concluded when the Guest House has duly accepted the application as stipulated in the preceding Article and has confirmed the payment of an accommodation deposit (corresponding to Accommodation Charges) through a bank transfer or by credit card by the date specified by the Guest House (within seven (7) days including bank holiday) (The Guest shall be liable for the relevant bank fees). However, the same shall not apply where it has been proved that the Guest House has not accepted the application.
  • The deposit shall be first used for the total Accommodation Charges to be paid by the Guest, secondly for cancellation charges, and thirdly for reparations under Article16. The remainder, if any, shall be refunded.
  • If the Guest fails to pay the deposit by the date specified by the Guest House, the Guest House shall treat the Accommodation Contract as invalid.

Article 5 (Refusal of Accommodation Contracts)

The Guest House shall have the right not to accept an application for an Accommodation Contract under any of the following circumstances:

  1. When the application for accommodation does not conform to the provisions of these Terms and Conditions;
  2. When the Guest House is fully booked and no room is available;
  3. When a person seeking accommodation is deemed liable to conduct himself/herself in a manner that will contravene the law, public order, or good morals due to his/her stay; 。
  4. When a person seeking accommodation is deemed falling under any of the following profiles:
    • a. Crime groups specified in Article 2 (2) of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991), crime group members specified in Article 2 (6) of said Act, quasi-members of such crime groups, its concerned personnel or other antisocial group members;
    • b. People employed by a corporation or an organization that is run by a crime group or members of such crime group;
    • c. People employed by a corporation whose board members include any crime group members;
  5. When a person seeking accommodation behaves himself/herself in a manner that will cause tremendous trouble to the neighborhood;
  6. When a person seeking accommodation is clearly identified as carrying an infectious disease;
  7. When a person seeking accommodation makes a demand with violence or unreasonable request to the Guest House;
  8. When the Guest House is unable to provide accommodation due to natural disasters, malfunction of facilities or other inevitable causes;
  9. When the situation applies to the provisions of Article 5 of the Kyoto Prefecture Ordinance for the Enforcement of the Hotel Business Law.
  10. When a person seeking accommodation brings in dangerous items (heating appliance such as stove, petroleum oil, etc.) and harmful goods to humans.

Article 6 (Right to Cancel Accommodation Contracts by the Guest)

  1. A Guest may cancel the Accommodation Contracts by notifying the Guest House.
  2. In cases where a Guest has cancelled an Accommodation Contract in whole or in part by any reason attributable to the Guest (except in the case when the Guest House has requested the payment of the deposit during the specified period as prescribed in Paragraph 1 of Article 3 and the Guest has cancelled before payment), the Guest shall pay the cancellation charges as listed in the Appended Table 2.
  3. In cases where the Guest does not appear by 18:00 (or 2 hours after the notified time of arrival) on the arrival date without any advance notice by the Guest, the Guest House may regard the Accommodation Contract as being cancelled by the Guest.

Article 7 (Right to Cancel Accommodation Contract by the Guest House)

The Guest House shall have the right to cancel the Accommodation Contract under any of the following circumstances;

  • When the Guest comes under any provisions of Article 5 (3) to (10);
  • When the Guest didn’t fulfill Paragraph 1 of Article 3.

Article 8 (Registration)

1. The Guest shall provide the Front Desk with the following details on the date of his/her arrival at the Guest House.

  1. Name, birthdate, sex, address of the Guest;
  2. Nationality and passport number for a Guest from abroad;
  3. Date and estimated time of departure;
  4. Other particulars deemed necessary by the Guest House.

Article 9 (Check-in / Check-out Time)

House from 3:00 p. m. to 11:00 a.m. the next morning. However,

  1. A Guest who stays for more than 2 consecutive days may occupy the room all day except for the days of arrival and departure.
  2. The Guest House may, notwithstanding the provisions prescribed in the preceding paragraph, permit the Guest to occupy the room beyond the Check-out Time. In such cases, extra charges shall be paid as follows:
    1. Up to 1 hour: 20% of the accommodation charge;
    2. Up to 2 hours: 40% of the accommodation charge;
    3. More than 3 hours: 100% of the accommodation charge.
  3. A Guest who stays for more than 2 consecutive days may occupy the room all day except for the days of arrival and departure, though housekeeping staff may enter the room for cleaning from 11:00 a.m. to 3:00 p.m.

Article 10 (Rules and Regulations)

The Guest shall, within our facilities, observe our Rules and Regulations set forth by the Guest House and put into our official website.

 

Article 11 (Payment of Accommodation Charges)

  1. The calculation method for Accommodation Charges that the Guest shall pay is provided in the Appended Table 1.
  2. Accommodation charges as stated in the preceding paragraph shall be paid, by the date specified by the Guest House, as accommodation deposit, through a bank transfer to a specified bank account or by credit card.
  3. Accommodation charges shall be paid by the Guest even if he/she voluntarily does not stay at the guest room after the commencement of occupancy.

Article 12 (Liability of the Guest House)

  • The liability of the Guest House concerning accommodation starts at the earlier time of either when the Guest is registered at the Guest House or when the Guest enters the room and terminates at the time when the Guest leaves the room to depart.
  • When the Guest House is unable to provide the contracted rooms, the Guest House shall arrange other accommodations of the same standard, insofar as possible, with the consent of the Guest, unless it is difficult due to a natural disaster or any other causes. In this case, Accommodation Charges for the dates when the Guest House is unable to provide the contracted room are not due.
  • In cases stated in the two preceding paragraphs, the Guest House shall be exempt from responsibility for compensation other than the relevant Accommodation Charges.
  • The Guest House doesn’t provide any services other than accommodation.

Article 14 (Handling of Deposited Articles)

The Guest House shall not be liable for any loss, breakage, or other damage to goods, cash, or valuables that were brought into the Guest House by the Guest, unless caused by an intentional or gross negligent act of the part of the Guest House.

Article 15 (Custody of the Guest’s Baggage or Belongings)

When baggage or belongings of the Guest are found in the Guest House after the Guest has checked out, and ownership of the article is confirmed, the Guest House shall inform the owner of the article left and ask for further instructions. When no such instructions are given to the Guest House by the owner or when ownership is not confirmed, the Guest House shall keep the items for seven (7) days from the day they are found, and then the items shall be reported to a local police station.

Article 16 (Liability of the Guest)

The Guest shall compensate the Guest House for damage caused through intent or negligence on part of the Guest.

Article 17(Jurisdiction and Applicable Laws)

Litigation arising from the Terms & Conditions for Accommodation Contract will be resolved in the Kyoto District Court and the Kyoto Summary Court that have jurisdiction over the location of the Guest House and in accordance with Japanese law.
